Trump Administration Actions Considered Unconstitutional, Illegal, or Unethical by Legal Scholars

Since President Donald Trump’s inauguration in January 2025, his administration has taken numerous actions that legal scholars have criticized as unconstitutional, illegal, or unethical. More than 950 law professors from across the country have signed a bipartisan letter stating, “We believe we are in a constitutional crisis.” This report examines the key areas where legal experts have raised serious concerns about the administration’s actions.

Executive Actions Against the Rule of Law
The Trump administration has issued several executive orders that legal scholars consider direct threats to constitutional principles and the rule of law. These actions appear designed to punish perceived opponents and have raised significant First and Fifth Amendment concerns.

Targeting Law Firms and Legal Opposition
In March 2025, President Trump issued executive orders targeting specific law firms that had represented his political opponents. The orders against Perkins Coie and Covington & Burling included revoking security clearances for their lawyers, limiting their access to federal facilities, and preventing government agencies from doing business with them. Legal experts have suggested these orders may violate constitutional rights:

“Legal experts have suggested that President Donald Trump’s executive orders, which revoke security clearances and implement other measures against two notable law firms, may infringe upon constitutional rights and reflect extraordinary acts of retaliation against attorneys who have previously opposed him.”

These actions appear to represent what some scholars describe as “extraordinary acts of retribution against lawyers who have crossed him in the past.” In an interview with Fox News, Trump further indicated he intends to target additional law firms, saying “We have a lot of law firms that we’re going to be going after, because they were very dishonest people.”

Mass Pardons and Clemency
On January 21, 2025, Trump issued sweeping pardons for nearly all federal defendants associated with the January 6 Capitol riot, dismantling what former Attorney General Merrick Garland had called “one of the largest, most intricate, and most resource-demanding investigations in our history.” These pardons covered approximately 1,500 defendants, including those convicted of violent assaults on police officers.

Former prosecutors and legal scholars have condemned these pardons as an abuse of power:

“[Legal experts] argue it undermines the diligent efforts of FBI agents, prosecutors, and federal judges—some of whom were appointed by Trump—following a process that led to charges against 1,583 individuals, over 1,000 guilty pleas, and more than 200 trial convictions.”

One Law professor from George Washington University described the pardons as “a devastating blow to the justice system,” arguing they represent “one of Trump’s most perilous abuses of power to date.”
