My comment was directed at this section of the article “The monument was built and maintained with private dollars. It is virtually identical to a monument on the grounds of the Texas State Capitol which the United States Supreme Court ruled to be permissible. It is a privately funded tribute to historical events, not a taxpayer funded endorsement of any religion, as some have alleged.”

I sure don't know , but I think the problem may be that its on State land . There was a 'satanist' on tely the other night saying that if the memorial doesn't come down then a 'satanist' memorial will be put up next to it .

Anyone that can read at the Junior High Level can plainly understand that the 1st Amendment and establishment clause restricts Congress, as in the United States Congress. NOTHING ELSE.

Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

SCOTUS has extended almost all of the first ten amendments to include state and local governments as well as the Federal government.
This is the doctrine of "incorporation" which was permitted by the 14th Amendment.
The last amendment to be incorporated was the 2nd amendment, in the MacDonald vs Chicago case.

This Ten Commandment case has nothing to do with any of that. The Oklahoma Supreme Court ruled it violated the Oklahoma constitution.
