Suspect in Kansas City Tesla arson freed from federal custody

KANSAS CITY, Mo. — A Missouri man accused of setting a fire at a Kansas City Tesla dealership has been freed from federal custody.   

FOX4 obtained court documents that spell out the defense’s reasons for releasing 19-year-old Owen McIntire from jail. He was arrested earlier this month in Boston.

Greg Watt, a former prosecutor and current state and federal defense attorney says this isn’t out of the ordinary.

“They’re looking at flight risk, they’re looking at threat to the community, those are the two overarching issues that any judge considers when releasing somebody out on bond,” he said.

“What the courts don’t want to do is put too much burden on the jail staff to extend unique care or specialized care if they don’t have to.”

Investigators believe McIntire, who lives in Parkville, Missouri, but attends college in Boston, used a Molotov cocktail to set fire to a Kansas City Tesla dealership in March. The fire damaged two Tesla Cybertrucks, but no one was injured.

A federal judge agreed to release McIntire from custody last week.

According to federal court documents, McIntire’s attorney argued he should be released citing “serious and ongoing” medical needs and treatments that McIntire’s attorney believed could not or would not be provided while in federal detention.

The defense filing says McIntire is undergoing treatment for depression, and is receiving gender affirming care that began in March of this year — and that care would likely be interrupted or terminated in federal custody.

McIntire’s attorney also cited his client’s lack of a criminal history and deep ties to the Kansas City area community as reasons he would not be a flight risk.

Watts emphasizes the fact that federal courts are way more equipped to handle suspects out on bond, due to having access to more resources and fewer cases than, say, state courts.

“This is not entirely out of the question. Could someone make the argument that it’s unique? Maybe, but I’ve seen this before,” Watt said.

Among the conditions of his release, McIntire must live with his parents, participate in a mental health program and take prescribed medication, and avoid all Tesla dealerships.

US Attorney General Pam Bondi has labeled the attacks on Tesla dealerships as acts of terrorism, but at this point, federal prosecutors have not filed terrorism-related charges against McIntire.

He faces one count of unlawful possession of an unregistered destructive device and one count of malicious damage by fire of any property used in interstate commerce.

FOX4 reached out to the government, and we are waiting to hear back. We also reached out to the attorneys representing McIntire, and they had no comment.

The 19-year-old is due back in federal court on Thursday at 1.

WASHINGTON – Emily Gabriella Sommer, 32, of the District of Columbia, was arrested today on a criminal complaint filed in U.S. District Court in connection with a May 8 incident during which she allegedly spit on former U.S. Attorney Edward R. Martin Jr. while he was participating in a video-recorded interview.

Sommer is charged with one count of assaulting, resisting, or impeding a government official.

The complaint was announced by U.S. Attorney Jeanine Ferris Pirro and Acting U.S. Marshal Ron Carter of the District Court for the District of Columbia.

According to the complaint, on May 8th, 2025, at approximately 3:30 p.m., then-Interim U.S. Attorney Martin was conducting an on-camera interview in front of the U.S. Attorney’s Office in the 600 block of D Street Northwest.

During the interview, the suspect, later identified as Sommer, approached Martin and stated words to the effect of, “Who in the f-- are you?” Martin turned to face Sommer. Sommer then said, “Are you Ed Martin? You are. Ed Martin.” Sommer lunged at Martin and spit on his shoulder. Sommer then walked eastbound on D Street Northwest and yelled, “You are a disgusting man. F--- you, Ed Martin. My name is Emily Gabriella Sommer, and you are served.”

Law enforcement identified the X account with username @EmilyGabriellaS and display name “Lefttits” as likely belonging to Sommer. On the evening of May 8, 2025, that account made several posts related to the incident.

On May 22, 2025, law enforcement located Sommer and placed her under arrest.

This case is being investigated by the U.S. Marshals Service. It is being prosecuted by Assistant U.S. Attorney Jacob Green.

A complaint is merely an allegation. All defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
